AG’s office declines to prosecute North Myrtle Beach restaurant owner in deadly shooting
HORRY COUNTY, S.C. (WMBF) – The South Carolina Attorney General’s Officed confirmed charges will not be filed a deadly shooting in the Longs area.
The AG’s office said that based on insufficient evidence, Weldon Boyd will not be charged in 33-year-old Scott Spivey’s death back in September along Camp Swamp Road and Highway 9.
An incident report shows that officers spoke with the driver of a white Dodge truck at the scene. The name of the driver is redacted from the incident report. The man claimed that Spivey, who had been driving the black truck at the scene, jumped out of the truck and started shooting.
The man told police he fired back.

While the name of white Dodge truck driver is redacted in the police report, the letter from the 15th Circuit Solicitor’s Office to the AG’s office confirmed that Boyd was the other shooter.
The solicitor’s office asked the AG’s office to get involved in the investigation after Boyd, the owner of Buoy’s on the Boulevard, wrote a post on Facebook thanking Horry County police and the solicitor’s office in the case.
Solicitor Jimmy Richardson said after that post he received several calls from community leaders with questions about the case.
The AG’s office said that it sent a letter to the State Law Enforcement Division, declining to prosecute Boyd.
